1. GENERAL CONDITIONS
1.1 These Terms and Conditions of Sale (“the Conditions”) apply whenever you (“Purchaser”) order or buy products from www.haymoz.se (“HAYMOZ”). The Terms and Conditions of Sale can be updated from time to time (e.g. to reflect changes in technology, our business model, system capacity or in relevant laws and regulations), and we therefore ask you to approve the Conditions each time you shop with us. Any reference to “you” or “your” means you as the “Purchaser”; any reference to “we”, “us” or “our” means HAYMOZ.
2. ORDERS AND PRICES
2.1. A purchase order from Purchaser constitutes Purchaser’s offer to HAYMOZ, and it will only become a binding agreement between the parties, upon HAYMOZ’s acceptance in writing by order confirmation or otherwise.
2.2. EU – All the prices are inclusive of Swedish VAT (25%). For countries outside EU – local VAT may be charged by your country’s customs authorities and this will be paid by the customer when your order arrives in your country. Custom fees may also be applied and are paid by the customer. If you have any questions don’t hesitate to contact us at hello@haymoz.se or for further assistance with your purchase.
2.3. Our online store at www.haymoz.se is open 24 hours a day but may be closed occasionally for maintenance; we try to perform such maintenance during the night whenever possible. An order placed on a public holiday will be processed the following weekday.
2.4. You must be at least 18 years of age to buy goods on our site, and you must own a valid credit card that is accepted by us. If you are under the age of 18, you must have legal grounds for wanting to place an order with us.
3. DELIVERY AND DELAY
3.1. Delivery of goods from www.haymoz.se is deemed to have occurred when the customer has received the goods. All orders ordered through www.haymoz.se are shipped with the best suitable carrier. Stock items will be shipped within a maximum of 10 days after ordering, unless otherwise stated on the product display. Delivery will usually take place within 1-2 business days after shipment. In special cases other freight solutions will be used. The stated delivery date is indicative and may therefore be waived. The shipment date will be clearly stated on the order confirmation. Furniture will be delivered to doorstep.
4. TERMS OF PAYMENT
4.1. We accept Credit / Debit Cards. For any other payment method please contact us.
4.2. Before making payment, you can revise the details you have entered, including delivery and billing addresses, or payment details. You can also change the goods ordered or remove goods from your basket. When you click “Buy and Pay”, a receipt will be shown on your screen. From that point on, you are bound by a purchase contract.
5. LIABILITY FOR DEFECTS
5.2. HAYMOZ’s liability does not cover defects arising out of or caused by (i) materials provided by Purchaser, (ii) faulty maintenance, incorrect use or incorrect assembly, (iii) alterations or repair performed by Purchaser or (iv) normal wear and tear of the products.
5.3. HAYMOZ only use high quality limestone and each stone is unique. The limestone’s differences in structure, shade, grain and content of fossils and corals gives it a lively character and natural shifts or even small wholes may occur on the surface. As well as that wood can vary regarding where the wood’s grain is located and this is a natural part of the material. You accept this when the order is placed. It will not be a considered defect and therefore no claim for refund.
5.4. Complaints/replacements can only be made to the original delivery address.
5.5. Apart from defects claims, Purchaser are in no instances entitled to return purchased products to HAYMOZ. Please contact us by e-mail to hello@haymoz.se if you have any questions.
6. CANCELLATION AND RETURNS
6.1. You can withdraw from the contract to purchase without giving any reason within 10 days. The right to cancel expires 10 days after the day you physically receive the goods. To exercise your right to cancel, you must inform us (see Contact Details above) of your decision to do so in an unambiguous declaration (e.g. a letter or an e-mail).
6.2. If you exercise your right to cancel, we will refund the originally invoiced amount. The refund will be made using the same means of payment you used for the original transaction. You will pay all costs related to returning the goods but will not be charged any form of fee as a result of the refund.
6.3. All items returned must be unused, in the same condition as when received, and must have all tags, including original packaging materials. Once we receive your return and the above conditions are met, the return will be processed no later than 10 working days. You will receive an email and the funds will be refunded to you in the same way as payment was made.
7. PRODUCT LIABILITY
7.1. HAYMOZ shall only be liable for damage caused by HAYMOZ’s products in accordance with the mandatory provisions of the Swedish Product Liability Act. HAYMOZ shall under no circumstances be liable for any indirect or consequential loss or damage, including but not limited to loss of profit, operating loss, loss of goodwill and loss of any contract.
8. LIMITATION OF LIABILITY
8.1. HAYMOZ shall in no event be liable for any indirect or consequential loss or damage, including but not limited to loss of profit, operating loss, loss of goodwill and loss of any contract.
8.2. HAYMOZ’s total and aggregate liability under or in connection with any purchase order shall in no event exceed the invoiced amount of such purchase order.
8.3. HAYMOZ shall not be liable for any errors in catalogues, brochures or other printed material submitted to Purchaser.
